Terms and Conditions of Trade
Terms and Conditions of Use Legal Information markevans.co.uk Terms and Conditions of Trade markevans.co.uk is a trading name of Jungle Television Limited. All orders for goods made by you and accepted by Jungle Television Limited ("Jungle Television/we/us") through markevans.co.uk, jungletelevision.com, jungletelevision.co.uk, jungletv.co.uk (the "Web site") are subject exclusively and strictly to these Terms and Conditions of Trade. Ordering All orders made by you through the Web site are subject to acceptance by us. We may choose not to accept your order for any reason. No contract will exist between you and Jungle Television for the sale by us to you of any product unless and until we accept your order by email confirming we have dispatched your product. That acceptance will be deemed complete and for all purposes to have been effectively communicated to you at the time we send you the email (whether or not you receive that email). If the goods you have ordered are not available from stock we will contact you by email and offer you the option to:
Description Of Goods & Prices After we receive your order, we will confirm by email the details, description and price for the items you have chosen. If these differ from the details, description and/or price shown on the Web site and you wish to cancel your order please see Cancelling an Order below. All details, descriptions and prices for the goods appearing on the Web site are correct at the time when the information was inputted. You should check any received goods on arrival to ensure that they are not faulty. We reserve the right to change the price and specification of any item on the Web site without notice. Right To Withdraw Items We reserve the right to withdraw any items from the Web site at any time and without notice. We will not be liable to you or anyone else for withdrawing any items from the Web site or refusing to process an order. Payment & VAT The total cost of your order is the price of the goods plus delivery charges as determined by the weight of the items ordered, and will be confirmed to you by the Web site and by email when the order is confirmed and again when despatched. Payment can be made by most major credit or debit cards and is taken by Protx. More information on Protx is available here. You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment, we will not be liable for any delay or non-delivery and we are not obliged to inform you of the refusal. We are not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card payment. The price for the goods as set on the Web site includes VAT for EU deliveries. We are not responsible for any other importation taxes, sales taxes or charges that may be levied at the delivery destination. Our VAT number is GB 528 6402 42. Delivery & Risk We despatch items ordered by you, as they are available using Royal Mail. Orders will only be sent to the address that you provide as the cardholder's address, which will be verified by Protx. We will use our reasonable endeavours to ensure that deliveries are sent out as soon as possible, but we cannot accept any liability for late deliveries. Once you have received the goods, all risk of damage to, or loss of, the goods shall pass to you. If you intend to cancel your order you must keep good care of the goods pending their return to us. Limitation Of Liability To the fullest extent permissible under law, we disclaim any and all warranties of any kind (whether express or implied) in relation to goods purchased by you through the Web site. Your statutory rights as a consumer are not affected. Our liability in contract, tort, negligence, pre-contract or other representations or otherwise arising out of or in connection with these Terms & Conditions of Trade shall be limited in aggregate to all sums paid by you to us. In any event, we shall not be liable to you under, or in connection with these Terms & Conditions of Trade in contract, tort, negligence, pre-contract or other representations (other than fraudulent or negligent representations) or otherwise for any economic loss (including without limitation loss of revenues, profits, contracts, business or anticipated savings) or for any special or indirect losses whatsoever. Nothing in these Terms & Conditions of Trade shall exclude or limit liability for death or personal injury resulting from our negligence or that of our agents or employees. Cancelling an Order If you want to cancel an order before it has been despatched then contact us by phone or email and we will cancel the order. Returns Policy If for any reason you are unhappy with your purchase, you can return it to us in its original condition within 30 days of the date you received the item and we will issue a full refund for the price you paid for the item. If the item is faulty we will refund postage costs incurred by you. If possible enclose a receipt from the post office. If you require a refund, the entire amount including initial delivery, will be refunded. If you are returning the item for any other reason we do not refund your return postage. If you are returning the item for a refund only the cost of the item is refunded and not the delivery charge. This returns policy does not affect your statutory rights as a consumer.
